Be Aware of New Laws for Background Checks for School Employees

In the past year, two bills relating to background checks for school employees became law. House Bill 79, which took effect in March 2007, requires individuals teaching under a professional teaching certificate to undergo a background check upon a date prescribed by the State Board of Education and every five years thereafter. Sept. 5, 2008, has been selected as the initial date by which professional certificate holders (eight year, permanent, and permanent non-tax) must have their checks completed.

HB 190 expanded this law, effective Nov. 14, 2007, by requiring professional certificate holders, including eight-year, permanent, and permanent non-tax, to have both the BCI and FBI checks completed by Sept. 5, 2008.

House Bill 190 also requires all non-licensed school employees to undergo both an Ohio criminal background check and an FBI criminal background check, conducted by the Bureau of Criminal Identification and Investigation (BCII). Sept. 5, 2008 is the date by which all non-licensed school employees (excluding van and bus drivers), must have completed the background checks. The checks for non-licensed employees must be redone every five years.

Important Notice Regarding Tax Deferred Retirement Plans

From: Patty A. Auck, Treasurer
To: All Employees:

The IRS recently issued regulations which affect 403(b) tax-deferred retirement plans in general and your 403(b) contract, specifically. Effective September 25, 2007, an exchange of your 403(b) contract for another 403(b) contract under the district’s 403(b) plan will be subject to new IRS restrictions and requirements. A failure to comply with these new restrictions and requirements can cause serious tax consequences.

Until further notice, it is important for you to confirm through the treasurer’s office that a proposed exchange will comply with the new IRS rules and the new provider is on the Employer’s list of approved providers before submitting it.
If you are contemplating an exchange to a provider not featured on the list, be sure to contact the treasurer’s office before moving forward. |

Thank you for your attention to this important procedural change.
